Terms of Sale

ModernCommerce is free, open-source software. There is no sale, purchase contract, licence fee, subscription, or paid edition required to download, install, use, inspect, modify, or redistribute it.

Nothing is being sold

This page exists to make the project’s position clear. Using ModernCommerce does not create a customer relationship, commercial subscription, support entitlement, service-level agreement, or purchasing obligation with Agunfon Interactivity LLC.

1. Free to use

ModernCommerce Core is provided without a purchase price. Individuals, organizations, educators, businesses, developers, and service providers may obtain and use the software without entering into a sales contract with Agunfon Interactivity LLC (“Agunfon”, “we”, “us”, or “our”).

There is no activation fee, platform revenue share, mandatory renewal, per-site charge, or per-user charge imposed by the ModernCommerce project.

2. Open-source licence

ModernCommerce Core is licensed under the GNU General Public License v3.0 or later, except where an included third-party component identifies another compatible licence.

Your rights to run, study, modify, and redistribute the covered software come from the applicable open-source licence. You must comply with that licence when copying, modifying, or redistributing covered work. This page does not replace, restrict, or expand the GPL.

3. No purchase or service contract

Downloading, installing, using, modifying, or contributing to ModernCommerce does not create a purchase contract or paid service agreement with Agunfon. It does not include guaranteed support, response times, implementation, hosting, maintenance, upgrades, security monitoring, compatibility work, or future features.

Any separate professional service would require its own clear written agreement. That separate agreement would govern only the stated service and would not reduce rights already granted under the GPL.

4. Voluntary contributions

Donations, sponsorship, and other voluntary project contributions help fund maintenance, documentation, testing, security work, compatibility, and open-source development. They are not a purchase of the software.

A voluntary contribution does not create ownership, exclusivity, a refund entitlement, a service-level agreement, priority support, delivery dates, or control over the roadmap unless a separate written agreement expressly says otherwise.

5. Your responsibility

You control the Moodle environment in which ModernCommerce runs. You are responsible for evaluating whether it is suitable for your needs, testing it before production use, maintaining restorable backups, securing your systems and credentials, monitoring operations, and confirming compatibility with your Moodle version, PHP version, theme, plugins, payment providers, and infrastructure.

You are also responsible for your products, prices, taxes, payment and merchant accounts, customer communications, refunds, privacy obligations, consumer rights, accessibility, record retention, and compliance with laws that apply to your operation.

6. No warranty

ModernCommerce is provided under the warranty and liability terms of its applicable open-source licence. To the fullest extent permitted by law, the software is provided “as is”, without a promise that it will be uninterrupted, error-free, secure, compatible with every environment, or suitable for a particular purpose.

Nothing on this website creates a warranty, support commitment, maintenance obligation, or guarantee of future development. Nothing in this statement excludes rights or liabilities that cannot lawfully be excluded.

7. Names and trademarks

The GPL applies to covered software code. It does not grant permission to use the Agunfon or ModernCommerce names, logos, brand assets, or identity in a way that suggests endorsement, certification, partnership, or official status.
